Factiva Holidays

Just a quick update for IAPE members at Factiva as we approach Thanksgiving: the Factiva contract is still in full force and, as called for in that contract, the day after Thanksgiving is a holiday for IAPE-represented Factiva employees.

By the way, there you are not a "former Factiva employee" (unless you've left the company entirely.) If you were a Factiva employee on the date of the Dow Jones buyout of Reuters you're still a Factiva employee and still covered by the Factiva contract. The Dow Jones buyout of Rejuters did not change your status or your contract.

The following Factiva contract provision applies to you.

ARTICLE 8 — HOLIDAYS

A. 1. The following shall be considered Company holidays in the United States: New Year's Day, President's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, the day after Thanksgiving and Christmas, or the days celebrated by the United States federal government as such.

2. The following shall be considered Company holidays in Canada: New Year's Day, Good Friday, Victoria Day, Canada Day, Labor Day, Thanksgiving, Christmas, Boxing Day (if the office in question is closed that day, but if such office is open, then the holiday will instead be added to the Personal Days), St. Jean Baptiste (Quebec Province) or Civic Day (Ontario Province) or the days celebrated by the Canadian federal government as such.

3. When an Employee is required to work on any of the above-mentioned holidays, he or she shall be paid at the rate of 1-and-a-half times the regular straight time rate for his or her regularly assigned daily hours and at double the regular straight time for hours worked in excess of that time. Also, he or she shall be given, at the discretion of the Company, an additional day's
pay at straight time rates or another day off, provided, however, that no such additional day off shall be a Saturday or Sunday, unless the Employee is regularly scheduled to work Saturday or Sunday.

In other words the day after Thanksgiving is a holiday at Factiva and if you have to work on the day after Thanksgiving, you're entitled to Holiday Pay: time and a half for the hours you work (double time for anything beyond your regular seven hours) AND another day off or another day of straight pay.
